I am on H1, 7th year extension. My Labor just got approved. About to file 140. Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1? My wife came to USA in 2002 on H4.She changed from H4 to H1 in 2004 Nov.Since then she worked continuously till now (Jan 2009).Now she's planning to take a break and change back to H4.If she wants to work again sometime in future maybe after a couple of years will she come under quota?Does she have to apply for a new H1 or can she work the remaining 2 yrs left on her H1?We missed the bus and could not apply for 485 in July. that is old stuff and also scary stuff for some people, even if old visas's are being recaptured, it was being done only for Schedule-A folks (nurses). So for all other EB categories where the only form of relief they are seeing is from possible recapture, if nurses take away those 200k (per Ombudsman its about 218K lost visas) then thats another big hope gone.
